Welcome to ChibiCart! These Terms of Service ("Terms") govern your use of ChibiCart, a Progressive Web Application (PWA) for shopping list management with AI-powered features. By accessing or using ChibiCart, you agree to be bound by these Terms.

1. Service Description

ChibiCart provides:

• Shopping List Management: Create, edit, and manage shopping lists
• AI Image Generation: Generate custom manga-style illustrations for items using AI technology
• Voice Input: Add items to lists using voice recognition
• Credit System: Monthly allocation of credits for premium features
• Progressive Web App: Offline functionality and app-like experience
• Data Synchronization: Sync data across multiple devices

2. Account Registration and Security

• You must provide accurate and complete information when creating an account
• You are responsible for maintaining the confidentiality of your account credentials
• You must notify us immediately of any unauthorized access to your account
• You are responsible for all activities that occur under your account
• We reserve the right to suspend or terminate accounts that violate these Terms

3. Acceptable Use Policy

You agree to use ChibiCart only for lawful purposes and in accordance with these Terms. You may not:

• Use the service for any illegal, harmful, or fraudulent activities
• Attempt to reverse engineer, decompile, or hack the application
• Interfere with or disrupt the service or servers
• Use automated tools to access the service without permission
• Share inappropriate, offensive, or copyrighted content
• Violate any applicable laws or regulations
• Attempt to circumvent usage limits or credit systems

4. AI Features and Content

• AI Image Generation: Uses Google's Gemini AI to create manga-style item illustrations
• Content Ownership: You retain rights to your shopping lists and personal data
• AI-Generated Content: AI-generated images are provided "as-is" without warranties
• Content Moderation: AI-generated content is subject to automated safety filters
• Usage Limits: AI features are subject to credit limits and fair use policies

5. Credit System and Billing

• Free Credits: Users receive 30 free credits monthly for AI features
• Credit Reset: Credits reset automatically on the first day of each month
• No Refunds: Credits are non-refundable and non-transferable
• Fair Use: Credit system is subject to fair use policies to prevent abuse
• Future Premium Features: We reserve the right to introduce paid premium features

6. Intellectual Property

• ChibiCart and its original content are protected by copyright and trademark laws
• You retain ownership of your personal shopping lists and data
• You grant us a limited license to process your data to provide the service
• AI-generated images are created using third-party AI services and are subject to their terms
• The ChibiCart brand, logo, and design elements are our intellectual property

7. Service Availability and Modifications

• We strive to maintain high service availability but cannot guarantee 100% uptime
• We may modify, suspend, or discontinue features with reasonable notice
• We reserve the right to update these Terms with notice to users
• Continued use after changes constitutes acceptance of new Terms

8. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, CHIBICART SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF DATA, LOSS OF PROFITS, OR BUSINESS INTERRUPTION, ARISING OUT OF YOUR USE OF THE SERVICE.

9. Termination

• You may terminate your account at any time through the app settings
• We may terminate or suspend your account for violations of these Terms
• Upon termination, your right to use the service ceases immediately
• We will retain your data according to our Privacy Policy and legal requirements

10. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of California, United States, without regard to its conflict of law provisions. Any disputes arising from these Terms or your use of the Service shall be subject to the exclusive jurisdiction of the state and federal courts located in California.
